Description
The burgeoning law of Intellectual Property is the reason for this third edition. The profusion of Intellectual Property Law reporting in Indian and foreign magazines makes us aware of the increasing flow of litigation and decisions on this subject. The importance and considerable growth of this law is reflected in a pertinent observation of Professor Cornish, the pioneer writer in this genre of jurisprudence. In the preface to the eight edition of his work, Intellectual Property, Patents, Copyright, Trade Marks and Allied Rights, published in 2013, Professor Cornish remarks that when his first edition appeared in 1981, “the teaching of intellectual property law in universities in Britain and other Common law jurisdiction was for the most part simply ignored. The subject used to be regarded by most judges, lawyers, industrialists, politicians, journalist, civil servants and individual inventors and creators as a recondite specialism that was best left to small bands of people who knew what it was about. Today it is too important and too controversial for such casualness to pass muster. The reach of the various types of protectors by patents, copyright, trademarks and so on has expanded and at the same time the relevant law has become more complex than before.” Journals in various jurisdictions screamble for their share in the case reporting market by printing increasing number of decisions on intellectual property law. Several decisions are applications of established  principles of law. They are useful from the point of view of looking at the insightful manner in which the courts have considered the problems in the cases they had to decide. While incorporating selectively the onslaught of further judicial decisions since the last edition, the opportunity is taken to revise or modify and enlarge some part of the earlier text. Foreign decisions of other common law jurisdictions particularly English decisions are continued to be noted.
