MITRA’S THE SPECIFIC RELIEF ACT

The basic objective of this book is to present the law in a simple and easy way so that all concerned may understand the basic rationality of each and every statutory provision as incorporated in this Act.

By Amendment Act of 2018, it has been made mandatory for the Court to grant specific performance. Now relief of specific of specific performance can be rejected only wehn it so barred by provisions of Act under Section 14 and Section 16 of the Act.

The Act enunciates the various reliefs which can be granted under it provisions, provisions for the exact fulfilment of the obligation or the specfic performance of contract.If it is directed to the obtaining of the very thing which a person is deprived of and ought to be entitled to ask for. It is a remedy by which a party to a contract is compelled to do or omits the very acts which he has undertaken to do or omit.
