Insolvency and Bankruptcy Lawes was conceptualized as a collaborative effort and joint publication of the Gujarat National Law University and Insolvency and Bankruptcy Board of India to provide different perspectives on the insolvency and bankruptcy law and practice in India and abroad. It intends to provide an understanding of the change in the insolvency and bankruptcy law while maintaining pace with the international standard. It is an attempt to understand the current practice of the insolvency law in India, problems encountered in its functioning, practices to be adopted from foreign jurisdictions and address any outstanding concerns. The coalition of collaborators is diverse and involves four sets of stakeholders-legal practitioners, academicians, regulators and research scholars-and their contribution to the growing debate surrounding the Insolvency and Bankruptcy Code, 2016 (IBC). The focus of the book is the IBC without being strictly confined to its study. The national section covers the history of the IBC and its functioning, judicial trends in the implementation and practice of the IBC, interplay of the IBC with other Indian laws, and emerging issues within the insolvency law. The international section provides a holistic view of the practice of insolvency across different regions. The book is a consolidated piece of work, essential for an understanding of the IBC addressing as it does the major issues concerning insolvency and bankruptcy laws while compartmentalizing India’s position against the trend abroad.

PROFESSOR (DR.) MAMATA BISWAL is a Professor of Law and Dean, Academic Affairs at Gujarat National Law University and Director of its Centre for Corporate and Insolvency Laws. Her areas of expertise are Corporate Laws, International Trade and Business Law (International Sales Law), and Insolvency and Bankruptcy Laws. Dr. Biswal was awarded the ICSSR Senior Fellowship in 2016-17. She has edited and authored books and book chapters, and contributed articles on various areas of law in international and Indian journals. She has presented research papers in international and national conferences and seminars on different areas of law. Dr. Biswal has conducted courses in various areas of Business, Corporate and Financial Market Laws. She has been a member of several committees and academic advisory bodies. She has been inducted as an independent woman director in the Gujarat-based PSUs-GSPC Pipavav Power Company Ltd, Gujarat State Energy Generation Limited and GSPC LNG Limited.
